4.1. Registration Requirements

When using our Service, you agree not to:

• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload, transmit, or distribute harmful content, including viruses or malware
• Engage in activities that could damage our reputation or business

5.2. Content Guidelines

You are solely responsible for all content published through our Service. This content must not:

• Infringe on intellectual property rights
• Contain hate speech, harassment, or discriminatory material
• Include sexually explicit, violent, or offensive content
• Promote illegal activities or services
• Misrepresent your identity or affiliation
• Violate any social media platform's terms of service

We reserve the right to remove any content that violates these guidelines.

5.3. AI-Assisted Features

You remain solely responsible for all content and actions published or executed through the Service, including actions assisted or suggested by AI systems.

6.1. Pricing and Billing

We offer various subscription plans with different features and pricing. All prices are subject to change with notice. By selecting a paid subscription, you agree to:

• Pay all applicable fees for your chosen plan
• Provide accurate and complete billing information
• Authorize us to charge your payment method for all fees incurred

6.2. Automatic Renewal

Unless otherwise specified, subscriptions automatically renew at the end of each billing period. You may cancel your subscription at any time through your account settings.

6.3. Refunds

Refund eligibility is determined on a case-by-case basis according to our refund policy. No refunds will be issued for partial subscription periods or for services already rendered.

6.4. Taxes and Invoicing

All prices indicated on the Service are exclusive of applicable taxes, unless stated otherwise. When required, VAT or other applicable taxes will be applied according to the User's billing country.

Invoices will be issued electronically unless the User expressly requests otherwise.

6.5. Right of Withdrawal (EU Consumers Only)

EU consumers have a legal right to withdraw from a digital subscription within fourteen (14) days from purchase.

However, by subscribing and accessing the Service immediately, the User expressly requests the immediate performance of the Service and acknowledges that they lose their right of withdrawal once the Service has been fully delivered or the premium features have been accessed.

Therefore, no refunds will be issued once the User has accessed the Service or used premium features.

7.1. Our Intellectual Property

The Service, including all of its components, features, and content (excluding User Content), is owned by Zapic and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, create derivative works from, display, perform, distribute, sell, or license any portion of the Service without our explicit permission.

7.2. User Content

You retain ownership of all content you create and publish through our Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content solely for the purpose of providing and improving the Service.

7.3. AI-Generated Content

Content generated through the Service using artificial intelligence is considered "User Content." The User is solely responsible for ensuring that such content complies with applicable laws and does not infringe third-party rights.

Zapic does not guarantee that AI-generated content will be free from copyright or trademark issues. The User assumes all liability for the publication and use of such content.

8.1. Platform Policies

Our Service interacts with various social media platforms, each with its own terms of service and policies. You agree to:

• Comply with all applicable platform policies and terms
• Not use our Service in ways that violate platform rules
• Accept that changes to platform policies may affect our Service functionality

8.2. Platform Authentication

We access your social media accounts through secure OAuth authentication. We do not store your social media passwords and only access the data necessary to provide our services as outlined in our Privacy Policy.

8.3. Platform Limitations

We cannot guarantee continuous availability or functionality of our integrations with third-party platforms. Changes to platform APIs, policies, or functionality may impact our Service performance.

8.4. Third-Party Platform Availability

The performance of certain Service features depends on the availability and functionality of third-party platforms. Currently, we support LinkedIn, TikTok, Twitter (X), Pinterest, Instagram, Facebook, Threads, and YouTube.

We do not guarantee continued access to or compatibility with these platforms, and we shall not be liable for any interruptions or changes caused by modifications to their APIs, features, policies, or systems.

10.1. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any such modifications, suspension, or discontinuation.

10.2. Termination by User

You may terminate your account at any time by following the instructions in your account settings. Upon termination, your right to use the Service will immediately cease.

10.3. Termination by Zapic

We may terminate or suspend your account and access to the Service at any time, with or without cause and without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

10.4. Effects of Termination

Upon termination:

• Your right to access and use the Service will cease immediately
• We may delete your account information and content
• Provisions that by their nature should survive termination shall survive

10.5. Compliance and Automated Abuse

We reserve the right to suspend or restrict access to the Service without prior notice if automated activity from a User account triggers platform security limits, violates third-party terms (including social media anti-spam rules), or poses a risk to platform integrity.

11.1. Informal Resolution

Before initiating any formal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at contact@zapic.ai.

11.2. Jurisdiction

If a dispute cannot be resolved amicably, any legal action or proceeding related to the Service shall be brought before the competent courts of Spain.

If the User is considered a consumer under applicable law, the courts of the User's place of residence shall have jurisdiction.

11.3. Applicable Law

These Terms shall be governed by and interpreted in accordance with the laws of Spain, without regard to conflict of law rules.
